ShelfSpace is operated by ShelfSpace LLC, a limited liability company registered in [STATE]. When we say "ShelfSpace," "we," "us," or "our" in these terms, we mean ShelfSpace LLC. When we say "you" or "client," we mean anyone who uses our website, signs up for early access, or purchases a plan.
ShelfSpace builds and manages custom retail CRM systems for independent makers, artists, and small-batch producers. We offer two service tiers:

By accepting free beta access, you acknowledge and accept these limitations. We will do our best to notify you of significant changes and to preserve your data, but cannot guarantee either.
During early access, Service-Managed plans are delivered on a best-effort basis. We do not guarantee specific outcomes such as a minimum number of leads per month, retail accounts landed, or response rates from targeted stores. These are outreach and relationship-building services and results depend on many factors outside our control.
As we gather data across clients, we will establish low, medium, and high performance benchmarks and communicate them clearly. Until those benchmarks are established, you are engaging with us on an early-access, best-effort basis.
Paid plans are billed monthly. By signing up for a paid plan, you authorize us to charge your payment method on a recurring monthly basis until you cancel.
All payments are final. We do not offer refunds for any reason, including partial months, unused time, or dissatisfaction with results. If you are unsure about whether ShelfSpace is right for you, we encourage you to apply for free beta access before committing to a paid plan.
You may cancel your plan at any time. Cancellation takes effect at the end of your current billing period. You will retain access to your dashboard until then. After cancellation, you can export your data at any time during the final billing period. We will delete your data from our systems within 30 days of your cancellation date, upon request.
The store contacts, lead lists, outreach notes, and business information you enter into your ShelfSpace CRM belong to you. You can export this data at any time using the built-in export tools in your dashboard. We will never sell your individual client data to third parties.
By using ShelfSpace, you grant us the right to access, analyze, and use your data in anonymized and aggregated form for product research, service improvement, and the development of industry benchmarks. We will never publish or share data in a way that identifies you or your business specifically without your written consent.
ShelfSpace owns all intellectual property related to the platform, including but not limited to: the dashboard software, design system, outreach templates, workflow methodology, and any tools or features we build. Your use of ShelfSpace does not transfer any IP rights to you. Your subscription grants you a limited, non-exclusive, non-transferable license to use your dashboard for the duration of your active plan.
Our website uses Google Analytics to understand how visitors use our site. This involves the use of cookies. By using our website, you consent to the collection of anonymized usage data by Google Analytics. You can opt out using the Google Analytics Opt-out Browser Add-on.
By submitting our contact or application form, you agree to receive email communications from ShelfSpace, including updates, newsletters, and information about our services. Every marketing email includes an unsubscribe link. You can opt out at any time.

ShelfSpace is provided "as is." We make no warranties, express or implied, regarding the reliability, accuracy, or fitness of the service for any particular purpose. We do not guarantee that use of ShelfSpace will result in retail accounts, revenue, or any specific business outcome.
To the fullest extent permitted by law, ShelfSpace LLC's total liability to you for any claims arising from your use of our service is limited to the amount you paid us in the 90 days preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages of any kind.
We may update these terms from time to time. When we do, we'll update the effective date at the top and notify active clients by email. Continued use of ShelfSpace after changes take effect constitutes acceptance of the updated terms.
These terms are governed by the laws of the State of [STATE], without regard to its conflict of law provisions. Any disputes will be resolved in the courts of [STATE].
